Effective Date: June 19, 2026
Regulatory Base: HIPAA, HITECH, TCPA, and Arizona State Healthcare Privacy Statutes

🔒 Protected Health Information (PHI) Notice

This document integrates our standard Website Privacy Policy with our formal healthcare Notice of Privacy Practices (NPP). Any Protected Health Information (PHI) you provide through our intake sheets, customer portals, third-party billing networks, or any associated Electronic Health Record (EHR) patient portals is protected under the Health Insurance Portability and Accountability Act (HIPAA).

1. Scope and Categories of Information Collected

Relatyv LLC (“we,” “us,” or “our”) collects various classifications of information to manage operations and optimize health-related service delivery through our Site, dynamic messaging streams, third-party business associates, and any applicable Electronic Health Record (EHR) systems. The data collected depends heavily on your interactions with our systems:

A. Consumer & Analytical Web Data (Non-PHI)

  • Technical data identifiers, cookies, log files, IP addresses, browser specifications, and dynamic tracking metrics detailing your engagement with our domain.
  • General demographic fields provided via non-clinical contact options.

B. Protected Health Information (PHI) & Clinical Intake Data

  • Personally Identifiable Information (PII), including physical name, telephone credentials, home address, and electronic mail coordinates.
  • Health metrics, clinical descriptions, past medical interventions, treatment histories, and records managed across any and all integrated EHR patient portals deployed by us or our clinical partners.
  • Financial metrics, insurance configurations, and claim documentation submitted via secure forms or our dedicated third-party clinical billing service vendors acting as Business Associates under HIPAA.

2. How We Use Your Protected Health Information (PHI)

Under the statutory frameworks of HIPAA, we utilize and disclose your Protected Health Information (PHI) without requiring separate written authorization for three core operational categories known collectively as TPO:

  • For Treatment: Utilizing health profiles to execute, coordinate, or evaluate clinical programs, therapeutic solutions, or scheduling structures within our organization or through any secure EHR patient portal network.
  • For Payment: Disclosing necessary billing data to our designated third-party clinical billing service vendors to process financial documentation, determine policy coverage rules, validate commercial healthcare insurance requests, and manage clearinghouse submissions.
  • For Healthcare Operations: Managing internal credentialing structures, executing rigorous legal or quality assurance reviews, conducting platform performance tuning, and executing general compliance audits across our entire operational architecture, including third-party utility interfaces.

3. Mobile Messaging Privacy & Strict Guardrails

As noted in our primary agreements, Relatyv LLC operates a dedicated operational SMS framework. We enforce explicit containment protocols concerning mobile privacy parameters:

  • Mobile telephone originator data, consumer consent profiles, and opt-in documentation records will never be distributed, traded, shared, leased, or sold to unauthorized third parties or marketing affiliates for promotional cross-tier execution.
  • SMS tracking frameworks and delivery parameters are maintained strictly for operational customer care, billing transparency, scheduling reminders, and systemic implementation workflows.

4. Disclosures Required or Permitted by Law

In specific secondary scenarios, legal or public safety metrics require us to share your information without obtaining your proactive consent:

  • Public Health Oversight: Activities including mandatory disease monitoring, medical product tracking, or child abuse declarations to state regulators.
  • Judicial or Administrative Mandates: Requests issued under an explicit court warrant, formal regulatory subpoena, or official discovery demand.
  • Law Enforcement Requests: Requests concerning victim tracking, criminal investigations, or immediate physical safety hazards.
  • Specialized Governmental Functions: Activities including national security initiatives, military clearances, or institutional inmate oversight.

5. Your Legal Individual Privacy Rights Under HIPAA

As an individual whose data is archived within our compliant networks, you possess comprehensive legal privileges regarding your health documents across any system we use, including third-party billing platforms and any and all EHR patient portals:

  • Right to Inspect and Copy: You preserve the explicit right to review and obtain copies of your medical records and billing histories. We will deliver these in standard electronic formats, or via the user dashboard of any applicable EHR patient portal.
  • Right to Amend: If you believe your health metrics or data files are inaccurate or incomplete within any EHR patient portal or billing registry, you can request an official structural amendment. We retain the right to deny this if the clinical data was generated by an external provider.
  • Right to an Accounting of Disclosures: You can request a historical register tracking instances where our teams shared your data for parameters outside TPO and basic operational authorizations.
  • Right to Request Restrictions: You may ask us to restrict the utilization of your PHI for treatment or operations. While we will consider all requests, we are not legally bound to accept every restriction, except for self-paid services.
  • Right to Alternative Communications: You retain the right to request that our infrastructure communicate with you via alternative channels or specific geographic destinations.

6. Technical, Administrative, & Physical Data Safeguards

Relatyv LLC deploys comprehensive cybersecurity practices engineered to protect your personal and clinical records. These safeguards extend to our third-party billing providers and any external platform integrations:

  • Advanced end-to-end data encryption applied to all records sitting at rest within our networks or traveling across transit pathways between our systems, third-party billing networks, and any and all EHR patient portals.
  • Role-Based Access Control (RBAC) protocols that strictly limit data access to authorized individuals who need it to fulfill their job duties.
  • Rigorous internal security auditing tracking file alterations, system access attempts, and authentication activities.

7. Structural Modifications to This Privacy Policy

We maintain the underlying right to adjust the parameters of this combined Privacy Policy and Notice of Privacy Practices at any point. When material updates are made, the revised policy will be posted on our digital platforms with an updated effective date. The updated privacy terms will apply equally to all data already stored in our systems as well as information collected in the future.
